Terms & Conditions Disclaimer:
The contents of this document supersede any prior Terms & Conditions documents. This document provides the Terms & Conditions applied to any and all memberships pertaining to OsteoStrong® Brea located at 750 N Brea Blvd #B, Brea, CA 92821. If there are any conflicts or misunderstandings pertaining to a membership, this document will be referred to and used to settle. BiohackMe Inc. reserves the right to amend, interpret, modify, any terms & conditions without prior notice. BiohackMe Inc. also reserves the right, with or without notice, in an individual case or generally, to change any of the policies applied to membership.
1. MEMBERSHIP PLANS
All membership plans, including promotions, fall under five membership types & four payment terms, listed below:
1.1 Membership Types
a) Bronze: Includes Spectrum Circuit and VibePlate (Once per week)
b) Silver: Includes Spectrum Circuit, VibePlate, and 1 add-on modality (Once per week)
c) Gold: Includes Spectrum Circuit, VibePlate, and 3 add-on modalities (Once per week)
d) Platinum: Includes Spectrum Circuit, VibePlate, and all add-on modalities (Once per week)
e) Diamond: Includes Spectrum Circuit (Once per week), VibePlate, and all add-on modalities
(Everyday we’re open, provided you schedule an appointment)
1.2 Membership Terms
a) Monthly: a recurring payment for a month-to-month membership billed on the same day of each month
b) Semiannual: a one-time prepayment for a 6-month membership with an option to renew
c) Annual: a one-time prepayment for a 12-month membership with an option to renew
d) Promotional: a one-time prepayment for ($XXX.XX) amount of sessions.
2. EQUIPMENT
2.1 Spectrum Circuit
a) One Spectrum Lower Growth Trigger (Used no more than once per week)
b) One Spectrum Upper Growth Trigger (Used no more than once per week)
c) One Spectrum Core Growth Trigger (Used no more than once per week)
d) One Spectrum Postural Growth Trigger (Used no more than once per week)
e) VibePlate (Used for at least 2 minutes both before and after each Spectrum Circuit session)
2.2 Add-on Modalities
a) Normatec Compression Boots (One 10-minute session)
b) Normatec Compression Hips (One 10-minute session)
c) iMRS Prime Pulsed Electromagnetic Field Mats (One 10-minute session)
d) JOOVV/Red & Near Infrared Light Therapy (One 10-minute session)
e) BioCharger NG hybrid subtle energy platform (One 8-15 minute session)
f) Zimmer Spot Cryo 6 (One 6-minute total session)
g) X3 bar (One workout)
3. RELEASE OF LIABILITY
3.1 Release of Liability
I state that I am physically capable of participating in a weight-bearing exercise or resistance training exercise program or the
Osteogenic loading session offered at OsteoStrong, including whole body vibration. I am physically capable of using the iMRS Prime PEMF Mats with the Exagon Brain. I assume all responsibilities for my decision to engage in these health protocols. I waive my right to pursue legal action against OsteoStrong, its owners, its partners, and agents for any physical or mental anguish that I may incur as aresult of my use of OsteoStrong,Spectrum Circuit, VibePlate, X3 bar, iMRS Prime PEMF Mat with Exagon Brain, NormaTec compression, BioCharger NG, and Joovv/Red Light Therapy, Zimmer Cryo 6. I have either received permission from my doctor to utilize any of theabove treatments, to perform any type of exercise listed above and the OsteoStrong exercise system or I decided to do so without consulting my physician even though OsteoStrong recommends all members concerned about exercising should consult a physician.
3.2 Cautions & Contraindications
a) Spectrum Circuit:
- Muscular Dystrophy
- Unmedicated Hypertension
- 3rd Trimester of Pregnancy
- Active Hernia
b) VibePlate:
With any of the following issues, consult your physician first before using any vibration machine. Recovering from surgery, have serious cardiovascular disease, or pregnant. You have thrombosis, joint implants, a pulmonary embolism, known retinal conditions,severe diabetes, a pacemaker, an implantable cardioverter defibrillators, hip or knee replacement, epilepsy, tumors, acute hernia, recently replaced pins or plates, or have a severe migraine. Because the VibePlate is much different than other vibration machines,we have had customers use the VibePlate for some of the above issues with no negative feedback. But we still ask you to consult yourphysician before using the VibePlate.
c) iMRS Prime Pulsed Electromagnetic Field Mats:
- Epilepsy
- Pregnancy
- Electronic Implants.
- Children younger than 2 years
d) BioCharger NG
Not Eligible to Engage:
- Pregnant women
- Anyone with electrical implants (pacemakers, metal plating in head; chemo ports; etc.)
- Anyone with non-removable insulin pumps (removable pumps must be removed)
Eligible to Engage with Preventative Measures:
- Photo-Sensitive Individuals: Use an opaque eye mask or turn your back to the BioCharger
- Under 18: Must be supervised by a parent or guardian
- Under 12: At least 3 feet away, the younger, the further back
e) JOOVV/Red & Near Infrared Light Therapy
Contraindication:
- Used the device with preventative measures if you are photosensitive
- Do not use the device if using topical, oral, or injectable steroids.
- Do not use the device during the healing period post Lasik eye surgery.
- Do not use the device if pregnant or lactating.
Precaution: Near Infrared (NIR) at 850 nm may aid hyper-pigmentation; discontinue use if this is a concern.
Post-surgery users should consult a physician prior to use. Users who have had laser hair removal could experience hair regrowth. Users with skin cancer or history of skin cancer should consult their physician prior to use. Users with pre-existing health conditions should consult their physician prior to use. Users with hyperthyroidism should consult with their physician prior to use, as use could increase symptoms. Users with black pigmented tattoos could experience skin blistering. Blistering can occur by inadvertent heating of the iron oxides and/or the metal salts in the tattoo’s black pigment. Tattoo locations can be covered prior to your treatment. Users with herpes virus could experience activation of dormant virus with use. Users taking medications such as Tetracycline, Digoxin, Retin A, and/or other photosensitive drugs, are recommended to consult with your healthcare provider prior to use. Users with a history of facial fillers and Botox injections should consult their dermatologist prior to use. Users with breast implants should consult their plastic surgeon prior to use.
f) NormaTec Recovery Leg & Hip Compressions
- Acute pulmonary edema
- Acute thrombophlebitis
- Acute congestive cardiac failure
- Acute infections
- Deep vein thrombosis (DVT)
- Episodes of pulmonary embolism
- Wounds, lesions, infection, or tumors at or near the site of application
- Where increased venous and lymphatic return is undesirable
- Bone fractures or dislocations at or near the site of application
- Unmedicated Hypertension.
3.3 Assumption of Risk & Indemnification Agreement
In consideration for being permitted by OsteoStrong Brea, I hereby waive any and all claims and damages for personal injury or death which may occur as a result of my participation. I understand and agree that: This release is intended to discharge in advance OsteoStrong Brea and its affiliates, its' officers, officials, employees, agents and volunteers from and against all liability arising out of or connected in any way with my participation in these activities. Participation may involve risk of serious injury, illness, disability or death and may result not only as a result of my actions, negligence or inaction, but also from the action, negligence or inaction of others, including their owners, officers, employees, or volunteers and may result from the conditions of the facilities, equipment, or areas where such activities are being conducted. Knowing the risks involved and the contraindications related, I neverthelesschose voluntarily to request permission to participate. I will indemnify and hold harmless OsteoStrong Brea and its affiliates, its' owners, officers, officials, employees and volunteers from any loss, liability, damage, cost or expense, including litigation of any form, arising out of or connected in any manner withmy participation in such activities. I am in good health and have no physical condition expressed in the 'Contraindications' or otherwise which would preclude me from safely participating in such activities. I understand and agree that this release is intended to be as broad and inclusive as permitted under law and that if any portion of this Hold Harmless, Release and Indemnification Agreement should be determined to be invalid, it is my intent that the remaining provisions shall continue in full force and effect. I will assume all responsibilities for my decision to engage in the Spectrum Circuit. I will not hold any OsteoStrong Brea or OsteoStrong Franchising, LLC, the owners, principles, partners, agents, affiliates, contractors, employees, parent company or subsidiaries liable or responsible for any physical injuries or mental anguish that I may experience as a result of my participation with the Spectrum Circuit. I state that I am physically and mentally capable of using the equipment. If I am a parent or legal guardian signing on behalf of minor, I am stating that the minor is physically capable of performing exercise. I have carefully read this release indemnification and hold harmless agreement and fully understand its contents. I am aware that this is a release of liability and a potential conflict between myself, and my heirs and OsteoStrong Brea and its affiliates, I voluntarily agree to each of the terms and provisions herein and sign this of my own free will. OsteoStrong Brea and its affiliates acknowledges that we are not medical professionals and that we can only share with you what positive results we have seen historically with clients. We do not treat or diagnose any disease or condition. We are only offering access to the therapy with no promises of any results. Every client is different and responds differently to
the therapy.
4. PAYMENT
4.1 Payment Authorization
I hereby authorize OsteoStrong Brea, or any of its affiliates, to charge my debit/credit card, or initiate ACH/EFT transfers, from my Designated Account for the purpose of paying all Dues, Fees and Charges, which I owe to OsteoStrong Brea per the terms of this Agreement, or until my membership is terminated. (a) How to Revoke this Authorization. I understand that I may revoke this authorization at any time by notifying OsteoStrong Brea. (b) Compliance with Designated Account Agreement. By signing below, I confirm that I am authorized under the terms of the applicable agreement with my financial institution (the "Bank Agreement") to use the Designated Account listed in this Agreement for the purchase of goods and services from OsteoStrong Brea. I certify that all statements made in this payment authorization are true and correct to the best of my knowledge. I understand that any failure by the applicable financial institution to pay any charges in full does not release me from any liability for obligations owing to OsteoStrong Brea. I agree to comply with the Bank Agreement at all times that this authorization is in effect. I acknowledge and consent to all of the terms to authorization and process all payments due under this Agreement.
4.2 Dues, Fees & Charges
You, as the Member or Payor, understands that by executing the authorization below, you will be responsible for payment of all amounts due under this Agreement, regardless of whether you use the OsteoStrong Brea facilities. OsteoStrong Brea reserves the right to change Dues, Fees and Charges at any time at its discretion. All changes will be informed to you via e-mail and/or text and will take effect 30 days after the date on which they are informed. You agree to pay any Dues, Fees and Charges by credit card or electronic funds transfer (ACH/EFT) from your designated checking account, savings account or debit card account ("Designated Account"). In addition, you agree to pay a non-refundable set-up fee upon execution of this Agreement. You agree to pay in advance recurring dues and as set forth in this Membership Agreement.
Membership for annual and semi-annual that are coming up for renewal, members will be notified 5 days before payment is withdrawn, if a member wants a refund, after their membership has been renewed, there will be a $100.00 charge to process that refund after we balance out the membership sessions counts (if applicable).
Monthly membership: If you cancel within the first month, there will be a $100.00 cancellation fee.
For annual or semi-annual memberships, cancellation incurs a $100.00 fee. The account will then be prorated based on the amount paid and used session, with the remaining balance refunded to the member's account. If you transfer the remaining balance to someone of your choice, there's an additional $100.00 setup fee. NOTES: Upon cancellation of any annual or semi-annual membership, all associated promotional offers, discounts,or benefits will be voided and no longer applicable.
4.3 Change of Membership Location
If you are an OsteoStrong Brea member, you may change this membership to another OsteoStrong location by written request at no charge.
If you decide to change this membership to another location, you agree to pay the difference, if any, in recurring membership dues.
5. MEMBER'S RIGHTS
5.1 Member's Right to Terminate
As a member, you have the right to terminate your membership. Termination forms are available via e-mail and/or text or at the front desk of our center. After you submit your termination form, your membership will be terminated within 30 days. Any membership dues within that period is still subject to being charged. You are also waiving your membership rate lock, and you are not subject to the same pricing or membership plans should you ever choose to return.
5.2 Hold Policy & Disability Provisions
If you become disabled or are unable to participate in the OsteoStrong® Brea program but do not wish to terminate your membership, OsteoStrong Brea has a hold policy in place so you, the member, can maintain your membership rate lock. The hold form is available via e-mail and/or text, also at the front desk of our center and can be mailed to OsteoStrong Brea, 750 N Brea Blvd #B, Brea, CA 92821, or delivered at the front desk of our centers. You may place your membership plan on "HOLD" at any time, as long as the account is in good standing. Good standing is defined as being active and current on all payments. All HOLD requests will be reviewed within 3 days of any form submission.
Holds may be placed for one month at a time and for up to two months per calendar year. After the two months have been exceeded in the calendar year, there will be a $25 charge per month to keep your account locked into your terms and conditions of your membership agreement.
NOTED: 5.1: after a total of 6 months of membership being on HOLD in any calendar year, it will be terminated without notifying the member and you are also waiving your membership rate lock, and you are not subject to the same pricing or membership plans should you ever choose to return.
You may NOT receive any type of treatment or services from any OsteoStrong centers during this period.
Should you wish to obtain services, the HOLD must be lifted and your membership will resume immediately.
Your plan will automatically resume the date you request to return to the regular billing cycle
Placing your membership on HOLD DOES NOT terminate your plan.+
5.3 Maximum Term
This Agreement is a month-to-month, semiannual or annual membership and will be automatically renewed every month, every 6 months or every year, until a cancelation notice is presented on the terms of the clause 5.1 above. Your billing period is indicated on the table “Member Plan” above.
I consent to the auto-renewal provisions described in this Section, including the possible continuation of payments for Monthly, Bi-annual or annual Recurring Dues Amounts.
6. GENERAL PROVISIONS
6.1 Consent to Image Use
You understand and acknowledge that while on OsteoStrong Brea premises, you, or your minor child's image (including live or recorded video images), may be used or shown on the OsteoStrong Brea or OsteoStrong Franchising LLC website and/or social media outlets (Facebook, Instagram, YouTube, etc.), and that by entering the premises you consent to the use of these images.
6.2 Consent to Contact
This Agreement shall constitute your express written consent for OsteoStrong Brea, to contact you by telephone, email or SMS text regarding any matter related to your account, including but not limited to, collection of any amounts past due, at the phone number and/or email address listed in this Agreement. In addition, by entering into this Agreement, you expressly consent to receiving promotions and other information from OsteoStrong Brea, its affiliates, and understand and agree that your information will be used for these purposes. You understand that your consent is not required and is not a condition of any purchase; your signature below, however, constitutes your consent to this provision. You may opt-out from receiving unsolicited text message from OsteoStrong Brea at any time, and you consent to receiving a text message confirming your opt-out selection.
